    5 Mistakes to Avoid When Going Through a Divorce

    Divorce is one of the most emotionally charged legal processes a person can go through and that emotional weight can lead to costly mistakes. Whether you’re just considering filing or already in the middle of proceedings, consulting an attorney early can make all the difference. What you do (and don’t do) now can have lasting consequences for your finances, your children, and your future. Here are five of the most common missteps to avoid.

    1. Oversharing On Social Media

    An attorney specializing in family law would tell you that venting posts about your ex or the vacation photo showing your new purchase can end up as Exhibit A in a courtroom. Attorneys routinely comb social media for evidence of undisclosed income, irresponsible behavior, or parenting choices that contradict what you’re claiming in court. The safest rule: treat every post as if a judge will read it. Consider going private or stepping away from social media entirely during proceedings.

    2. Hiding Or Misrepresenting Assets

    Concealing assets such as moving money into a friend’s account, downplaying the value of a business, or failing to disclose retirement accounts is not just legally risky; it can be catastrophic. Courts take financial dishonesty extremely seriously. If discovered, a judge can award a larger share of the marital estate to your spouse as a penalty, and in some cases, you may face sanctions or contempt charges. Full financial transparency isn’t optional, it’s required.

    3. Making Informal Custody Arrangements

    It’s common for divorcing parents to reach a verbal understanding about custody such as school pickups, holiday schedules, who takes the kids on weekends. But handshake agreements aren’t enforceable. If your co-parenting relationship sours down the road, you could find yourself fighting over terms that were never legally documented. Any custody arrangement should be formalized in a court-approved parenting plan that clearly defines schedules, decision-making rights, and dispute resolution procedures.

    4. Letting Emotions Drive Legal Decisions

    There’s no doubt that divorce is painful, and it’s natural to want to “win.” But allowing anger or hurt to guide your legal strategy often leads to prolonged litigation, higher attorney fees, and worse outcomes for everyone, including your children. Refusing a reasonable settlement out of spite, filing unnecessary motions, or using court proceedings as a weapon rarely ends well. Work with your attorney on what a fair result looks like and stay focused on that goal, not the conflict.

    5. Neglecting To Update Legal and Financial Documents

    Once the divorce is final, many people exhale and move on, but failing to update your will, life insurance beneficiaries, retirement accounts, and powers of attorney can haunt you for years. Without those updates, your ex-spouse could still inherit your estate or make critical medical decisions on your behalf. Review and revise every legal and financial document as soon as the ink is dry. This final step is just as important as everything that came before it.

    Divorce doesn’t have to define the rest of your life, but the decisions you make during the process can. Protecting yourself legally, financially, and emotionally starts with avoiding these common pitfalls.
